Claudia B. alleged that she underwent an abortion at Womancare late in December of 1983. She had what she believed to be a menstrual period in late February, 1984. in early April, Claudia had a positive pregnancy test. In late April and early May of 1984 Claidia went to the emergency room of the Hillsdale Community Health Center with a one week history of bleeding and sudden onset of severe cramping and increased bleeding. On May 3, she underwent a D&C which produced a large amount of placental tissue including a small macerated fetus consistent with a 14 to 16 week pregnancy. The treating physician wrote in Claudia's case summary that the abortion physician "did not remove the gestational productions completely by any means. I suspect that she continued to have a normal pregnancy for a few months after that, when she began to abort spontaneously." Claudia faulted Womancare with failure to analyze the abortion tissue; failure "to ascertain and insure that trained and competent personnel were and would be caring for...Plaintiff and allowed untrained and/or unqualified personnel to do so," and lack of informed consent Claudia had to be hospitalized. Marilyn S. alleged that she underwent an abortion on December 10, 1983. Afterward she wanted to sue, but Womancare would not release her medical records to her attorneys. Christine K. underwent an abortion by Lee Stevenson at Womancare on December 4, 1981. Christine faulted Stevenson with negligence in advising her that her abortion had been successful, and in his failure to conduct pathology tests. Christine returned for follow-up on December 19, but the defendants failed to detect her continuing pregnancy. Christine's infant girl was born July 2, 1982.
